NEW YORK- JetBlue Airways (B6) faces a federal lawsuit from a passenger who suffered a fractured tooth from an allegedly “dangerously cold” ice cream sandwich served during a transatlantic flight.
Karla Quinonez filed the lawsuit Tuesday (October 22, 2024), claiming the airline’s negligence in serving and failing to warn about the frozen dessert’s solid state led to severe dental injury, the Independent reported.
JetBlue Sued by Passenger
Court documents reveal that during JetBlue flight B61907 from New York JFK to Paris (CDG) on August 20, Quinonez received a Nightingale Ice Cream Company’s “chomp size” strawberry shortcake ice cream sandwich.
The impact of biting into the frozen treat resulted in a root fracture of her upper left lateral incisor (tooth number 10), requiring immediate medical intervention upon landing in Paris.
The dental emergency forced Quinonez to undergo an emergency tooth extraction, followed by an implant procedure and ongoing dental care after returning to the United States.
The legal complaint emphasizes JetBlue’s responsibility for serving food at unsafe temperatures and highlights their failure to inform passengers about the product’s frozen condition.
Quinonez’s lawsuit attributes her physical injuries, emotional distress, and continued medical expenses directly to JetBlue’s negligent service practices.

The trend extends beyond JetBlue, as evidenced by a Michigan woman’s lawsuit against American Airlines. She claims severe first and second-degree burns across her legs, thighs, and genital area from a coffee spill incident.
Returning to Quinonez’s ice cream incident, her legal complaint emphasizes JetBlue’s breach of their duty of care toward passenger safety. The ongoing dental treatment has imposed a significant financial burden on Quinonez, with her legal team asserting she bears no fault for the injury.
Through her attorney Christopher Fraser, Quinonez seeks unspecified monetary damages, to be determined by a jury, plus compensation for legal expenses.
