While Southwest claimed it took disciplinary action against Roebling due to his use of vulgarity, the union argued that the move resulted from his decision to join the union&#8217;s check pilot committee.<\/p>\n\n\n\n<p>A lower court judge had previously ruled that the dispute was a minor matter and therefore belonged in arbitration. However, the appeals court panel, led by Chief Judge Jennifer Walker Elrod, agreed with the lower court&#8217;s assessment but noted that the accusations against Southwest made this case different.<\/p>\n\n\n\n<p>The appeals court found that the union&#8217;s allegations &#8211; that Southwest made check pilots fearful of retaliation for associating with the union, and that Roebling&#8217;s boss threatened to strip him of his qualifications &#8211; &#8220;sufficiently support the union&#8217;s claim that Southwest intended to &#8216;weaken&#8217; or &#8216;destroy&#8217; the operational capacity of the union.&#8221;<\/p>\n\n\n\n<p>In a statement, Southwest said it disagreed with the court&#8217;s decision and vehemently denied the union&#8217;s allegations, adding that the company is &#8220;evaluating [its] options.&#8221; Lawyers for the union did not immediately respond to requests for comment.<\/p>\n\n\n\n<p>The appeals court has returned the case to U.S. District Judge Barbara Lynn in Dallas federal court, where the lawsuit was initially dismissed in September 2023.<\/p>\n\n\n\n<p>Which is your favorite US airline in terms of flight crew it hires?
