The case concerns seats aboard Boeing 737, Boeing 757 and Airbus A321 aircraft, where passengers allegedly discovered blank cabin walls instead of windows after boarding.

The lawsuit estimates that more than one million Delta passengers could have been affected by the practice. On November 4, 2026, US District Judge Ramon E. Reyes Jr. rejected Delta’s attempt to have the case dismissed, allowing the passengers’ breach of contract claims to proceed. The decision follows a similar ruling against United Airlines (UA) in July 2026 over comparable allegations.

Photo: Delta Air Lines

Delta Lawsuit Advances

The case, known as Meyer v. Delta Air Lines, was originally filed on August 19, 2025, in the US District Court for the Eastern District of New York.

The lawsuit was brought after passenger Nicholas Meyer alleged that Delta charged him extra for window seats on a journey from LaGuardia Airport (LGA) to John Wayne Airport (SNA), with a connection through Hartsfield-Jackson Atlanta International Airport (ATL).

Meyer claimed that he selected window seats for both flights but discovered that seat 23F on a Boeing 757-200 was positioned against a blank cabin wall. He reportedly spent the approximately four-and-a-half-hour flight without the window view he expected when purchasing the seat.

The complaint alleges that certain aircraft have windowless seats because air-conditioning ducts, electrical conduits, and other internal equipment occupy the space behind cabin panels.

However, Delta allegedly continues to identify these positions as window seats during the booking process without informing customers about the missing windows.

Judge Reyes rejected Delta’s argument that federal aviation law prevented the passengers from pursuing their breach of contract claims. The decision does not establish that the airline is liable, but it means the proposed class action can continue through the legal process.

Photo: By Charles – https://www.flickr.com/photos/charles79/52699473700/, CC BY 2.0, https://commons.wikimedia.org/w/index.php?curid=138210993

Delta Defends Seat Fees

Delta argued that its Contract of Carriage does not guarantee passengers a particular seat or promise that a seat classified as a window seat will provide an outside view.

The airline also pointed to its contractual language stating that seat assignments are not guaranteed and do not form part of the contract.

The carrier further argued that claims based on seat maps, booking information and marketing descriptions were preempted by the federal Airline Deregulation Act. This law limits certain state-level regulation of airline services and pricing.

The plaintiffs, represented by New York-based law firm Greenbaum Olbrantz, maintain that advertising a seat as a window seat creates a reasonable expectation that an actual window will be available.

They argue that passengers would not have paid additional seat-selection fees if Delta had disclosed the limitations before purchase.

The lawsuit also highlights differences in how airlines communicate seat restrictions. According to the plaintiffs, competitors including American Airlines and Alaska Airlines identify seats without window views during the selection process, allowing passengers to make informed decisions.

The plaintiffs are seeking financial damages and changes to Delta’s booking system so that passengers can identify windowless seats before paying for them.

Representative Photo: United Airlines

United Faces Similar Case

Delta is not the only major US airline facing legal action over windowless seats. United Airlines also faces a proposed class action after passengers alleged that they paid extra for window seats but were assigned positions beside blank cabin walls.

In July 2026, US District Judge James Donato rejected United’s attempt to dismiss the case, allowing the passengers’ claims to proceed.

United had argued that the term window seat described its position next to the aircraft’s cabin wall rather than guaranteeing an outside view, Simple Flying flagged.

The two cases could increase pressure on airlines to provide clearer information about seat characteristics during online booking.

Passengers increasingly pay additional fees to select preferred locations, making accurate seat descriptions an important part of the purchasing process.

For Delta, the latest ruling means it must continue defending its seat-selection practices in court. However, the case remains unresolved, and the allegations have not yet been established as legal violations.

Stay tuned with us.
