An investigation by CBC’s Go Public published on October 26, 2026, identified four cases in which flight records raised questions about the airline’s explanations for withholding payments under Canada’s Air Passenger Protection Regulations.

The investigation found that the airline moved functioning aircraft to routes where other planes required maintenance, leaving passengers on the original services facing cancellations. Air Canada told Go Public that it had moved Rojas’s aircraft to cover for the damaged plane.

In January 2026, a CTA complaint resolution officer ordered Air Canada to pay Rojas C$1,000.

The officer determined that swapping aircraft to reduce delays for passengers on one route at the expense of those on another was a commercial decision and did not justify withholding compensation from affected passengers.

Photo: Airbus

Four Cases Identified

Go Public identified three other passengers who said Air Canada had denied compensation after similar aircraft changes.

Michael Bociurkiw received notice that his Vancouver (YVR) to Newark (EWR) connection had been cancelled for safety-related maintenance while he was travelling on the aircraft whose registration was cited in the explanation.

In two further cases, Carlos Fernandez’s Las Vegas (LAS) to Toronto (YYZ) flight and Alison Monaghan’s Toronto to Vancouver flight were cancelled after aircraft changes.

Flight records reviewed by Go Public indicated that the planes originally assigned to those services subsequently operated on other routes.

Air Canada acknowledged that all four cases involved commercial decisions to reassign functioning aircraft to routes where scheduled aircraft required safety-related maintenance.

The airline argued that aircraft schedules are fluid and that operational adjustments help minimize the overall impact on passengers. The CTA said it had not fined Air Canada for incorrectly characterizing a cancellation as safety-related maintenance, while the agency said it planned to begin publishing passenger-dispute decisions in 2027 after addressing privacy concerns.

Advocates are calling for clearer rules and stronger enforcement so passengers can challenge compensation denials with access to relevant information. Air Canada declined Go Public’s request for an interview but provided a written response defending its operational decisions.

Stay tuned with us.
