She planned to return on Friday, October 23. The investigation began before her scheduled return, when deputies received an emergency call from one of her children.

Shortly after 8:30 PM on Wednesday, October 21, a child called 911 after a dumbbell struck her 9 year old brother on the head. Deputies responding to the family’s home found all four children without an adult present.

Emergency responders transported the injured boy to a hospital, where he received treatment and was later discharged.

Deputies contacted Miller by phone. She reportedly explained that she was working in Las Vegas and had arranged for a babysitter to travel from Tampa each morning to help the children prepare for school and return later to check on them.

However, the babysitter was not required to stay overnight. The arrangement therefore provided daytime assistance but left the children without a resident adult during the night.

Authorities also contacted the children’s father, who agreed to take all four children to his home. The children were placed with him after the emergency, ending the original supervision arrangement before Miller’s planned return.

Detectives arranged to meet Miller as her flight arrived at Orlando International Airport (MCO) on Friday, October 23. Deputies arrested her as she stepped off the aircraft.

Miller was booked into Orange County Jail on four counts of child neglect without great bodily harm, one count for each child. Subsequent reporting confirmed that she posted bond and was released.

The Osceola County Sheriff’s Office released body-camera footage of the airport arrest. The charges remain allegations, and an arrest does not establish guilt.

Florida Law About Leaving Children Home Alone

Florida does not specify a minimum legal age at which a child can stay home alone.

Instead, the state’s child-welfare guidance emphasizes the circumstances surrounding the decision, including a child’s maturity, physical ability, judgment and capacity to handle an emergency.

There is no universal number of hours that automatically determines whether an arrangement constitutes neglect.

A change to Florida law took effect on July 1, 2025, clarifying the protection given to reasonable childhood independence.

The law recognizes that sufficiently mature children may participate in independent activities, including walking or cycling to nearby locations, playing outdoors and remaining at home for a reasonable period.

That protection is not unlimited. Under Florida Statute 827.03, allowing an independent activity may fall outside the protection when it constitutes willful and wanton conduct that endangers a child’s health or safety.

The statute also defines neglect in terms of a caregiver’s willful failure to provide necessary care and supervision. In certain circumstances, a single incident can qualify if it causes, or could reasonably be expected to cause, serious physical or mental injury or creates a substantial risk of death.

Florida generally classifies child neglect without great bodily harm as a third-degree felony when the statutory requirements are met. The legal question is whether the alleged conduct satisfies the elements of that offense, not simply whether a parent made a questionable supervision decision.

The 9 year old’s injury explains how authorities learned that the children were alone, but the injury alone does not determine whether criminal neglect occurred.

Investigators and prosecutors must consider the full circumstances, including the children’s ages, the duration of the arrangement, the level of supervision provided and the risks they faced.

The child’s ability to call 911 may be relevant to assessing how the children responded to an emergency.

However, making an emergency call does not by itself prove that the overall supervision arrangement was appropriate. Both the injury and the children’s response must be considered in context.

Photo: By Miosotis Jade – Own work, CC BY-SA 4.0, https://commons.wikimedia.org/w/index.php?curid=49615900

Childhood Independence and Debate Over Felony Charges

The case has prompted debate about how expectations for child supervision have changed. Online commenters have compared the incident with earlier generations, when some children spent time alone, visited friends without adult supervision and returned home by dark, often without access to mobile phones.

As discussed in View from the Wing, the commentary also recalled the author’s own experience of going out independently during elementary school. However, it distinguished that kind of everyday freedom from leaving a 14 year old responsible for 3 younger siblings overnight while a parent traveled across the country for 5 nights.

The author questioned whether felony charges were appropriate, without suggesting that the supervision arrangement itself was necessarily acceptable.

However, it distinguished that kind of everyday freedom from leaving a 14 year old responsible for 3 younger siblings overnight while a parent traveled across the country for 5 nights.

Photo: Delta

What Happens Next?

Miller has been charged with four counts of child neglect without great bodily harm and was released after posting bond. The available reports do not establish a finding of guilt.

The case will turn on the evidence surrounding the children’s supervision, the arrangements Miller made, and whether her conduct meets Florida’s legal definition of neglect.

It also highlights why daytime check-ins may not address the risks associated with leaving several children without overnight adult supervision for an extended trip.

Stay tuned with us.
