Haak later pleaded guilty to a federal crime.<\/p>\n\n\n\n<p>First Officer Christine Janning says the incident involved more serious conduct and that Southwest and the <a href=\"https:\/\/aviationa2z.com\/index.php\/tag\/swapa\/\">Southwest Airlines Pilots Association<\/a> retaliated against her after she reported it. Haak, a 27 year Southwest captain approaching retirement, had used his seniority to pick up the trip. According to Janning, the 2 had never met before the flight.<\/p>\n\n\n\n<p>At cruising altitude, Haak allegedly said there was something he wanted to do before retiring. He locked the cockpit door, left his seat, removed his clothing and began watching p*rn on a laptop while Janning continued flying the <a href=\"https:\/\/aviationa2z.com\/?s=737\" target=\"_blank\" rel=\"noreferrer noopener\">Boeing 737<\/a>.<\/p>\n\n\n\n<p>The criminal case established that Haak disrobed, watched p*rn and engaged in additional inappropriate conduct. He pleaded guilty to committing a lewd, indecent or obscene act and received one year of probation and a $5,000 fine.<\/p>\n\n\n\n<p>Janning&#8217;s September 2022 complaint alleges that the s*xual conduct lasted more than 30 minutes. She says Haak photographed and recorded himself, encouraged her to participate and became angry when she refused. She says she photographed him to preserve evidence while continuing to operate the aircraft.<\/p>\n\n\n\n<p>Later complaints allege that Haak blocked her exit, threatened to crash the aircraft if she resisted and threw the napkin he had used toward a waste bag, striking her arm and leaving it on the center pedestal.<\/p>\n\n\n\n<p>Haak described the incident as a \u201cconsensual prank\u201d that got out of hand. She says Southwest told her 6 days later that it would not conduct an internal investigation because Haak had retired.<\/p>\n\n\n\n<p>She met with the FBI on December 2. One week later, Southwest removed her from flying while she was in Denver. The chief pilot cited Section 2.C of the pilot contract, which covers removal for a possible offense, questionable occurrence or fitness-for-duty issue.<\/p>\n\n\n\n<p>Janning says the wording made it appear that she might be under investigation or considered psychologically unfit to fly. She also alleges that the letter circulated to more than 25 Southwest and SWAPA employees and included her home address.<\/p>\n\n\n\n<p>She says she remained grounded for about 105 days, lost flight currency and recurrent training, and was underpaid by nearly $30,000. She returned to the line in March 2021.<\/p>\n\n\n\n<p>Janning also alleges that managers and pilots described her as mentally unstable, a dangerous pilot and promiscuous, and falsely suggested that she had a prior relationship with Haak. During her grounding, she says her captain upgrade was revoked.<\/p>\n\n\n\n<p>Janning claims Southwest and SWAPA worked together to ground her, discredit her and retaliate against her after she reported Haak.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"680\" src=\"https:\/\/aviationa2z.com\/wp-content\/uploads\/2024\/01\/image-138.png\" alt=\"Southwest Pilot Reported a N*ked Captain in the Cockpit. The case includes claims against Southwest for negligent supervision, negligent retention, retaliation, s*x discrimination, hostile work environment, libel and slander.<\/p>\n\n\n\n<p>Haak faces claims for s*xual assault, s*xual battery and false imprisonment. Former Southwest managers face defamation claims, while SWAPA is accused of participating in a civil conspiracy with Southwest.<\/p>\n\n\n\n<p>In December 2023, SWAPA moved to dismiss, arguing that Janning had not plausibly connected the union to an agreement to retaliate against her.<\/p>\n\n\n\n<p>SWAPA now argues that the claims against it are sufficiently frivolous to justify sanctions and payment of the union&#8217;s legal fees. The union initially sought to keep the sanctions motion confidential, but the Orange County, <a href=\"https:\/\/aviationa2z.com\/?s=Florida\" target=\"_blank\" rel=\"noreferrer noopener\">Florida<\/a> clerk rejected that request.<\/p>\n\n\n\n<p>The sanctions request remains part of the ongoing civil dispute.
