DALLAS-<\/strong> Southwest Airlines (WN)<\/a> became embroiled in a major cockpit misconduct case after Captain Michael Haak stripped naked and watched p*rn during Flight 6607 from Philadelphia International Airport (PHL) to Orlando International Airport (MCO) on August 10, 2020. Haak later pleaded guilty to a federal crime.<\/p>\n\n\n\n

First Officer Christine Janning says the incident involved more serious conduct and that Southwest and the Southwest Airlines Pilots Association<\/a> retaliated against her after she reported it. SWAPA now seeks sanctions against Janning and her lawyers, including payment of the union’s legal fees.<\/p>\n\n\n\n

What Happened on Southwest Flight<\/h2>\n\n\n\n

On August 10, 2020, Janning was first officer on Southwest Flight 6607 from Philadelphia<\/a> to Orlando. Haak, a 27 year Southwest captain approaching retirement, had used his seniority to pick up the trip. According to Janning, the 2 had never met before the flight.<\/p>\n\n\n\n

At cruising altitude, Haak allegedly said there was something he wanted to do before retiring. He locked the cockpit door, left his seat, removed his clothing and began watching p*rn on a laptop while Janning continued flying the Boeing 737<\/a>.<\/p>\n\n\n\n

The criminal case established that Haak disrobed, watched p*rn and engaged in additional inappropriate conduct. He pleaded guilty to committing a lewd, indecent or obscene act and received one year of probation and a $5,000 fine.<\/p>\n\n\n\n

Janning’s September 2022 complaint alleges that the s*xual conduct lasted more than 30 minutes. She says Haak photographed and recorded himself, encouraged her to participate and became angry when she refused. She says she photographed him to preserve evidence while continuing to operate the aircraft.<\/p>\n\n\n\n

Later complaints allege that Haak blocked her exit, threatened to crash the aircraft if she resisted and threw the napkin he had used toward a waste bag, striking her arm and leaving it on the center pedestal.<\/p>\n\n\n\n

Haak described the incident as a \u201cconsensual prank\u201d that got out of hand. His lawyer claimed Janning encouraged him to fly naked and denied that he m*sturb*ted.<\/p>\n\n\n\n

Janning Says Southwest Grounded Her After She Reported It<\/h2>\n\n\n\n

Janning reported the incident to Southwest employee relations. She says Southwest told her 6 days later that it would not conduct an internal investigation because Haak had retired.<\/p>\n\n\n\n

She met with the FBI on December 2. One week later, Southwest removed her from flying while she was in Denver. The chief pilot cited Section 2.C of the pilot contract, which covers removal for a possible offense, questionable occurrence or fitness-for-duty issue.<\/p>\n\n\n\n

Janning says the wording made it appear that she might be under investigation or considered psychologically unfit to fly. She also alleges that the letter circulated to more than 25 Southwest and SWAPA employees and included her home address.<\/p>\n\n\n\n

She says she remained grounded for about 105 days, lost flight currency and recurrent training, and was underpaid by nearly $30,000. She returned to the line in March 2021.<\/p>\n\n\n\n

Janning also alleges that managers and pilots described her as mentally unstable, a dangerous pilot and promiscuous, and falsely suggested that she had a prior relationship with Haak. She says the 2 had never met before the flight.<\/p>\n\n\n\n

Earlier Complaints About Haak<\/h2>\n\n\n\n

Janning alleges that 4 crew members reported Haak to SWAPA Professional Standards in 2008 for s*xual harassment, s*xual assault and exposing himself.<\/p>\n\n\n\n

Her Fourth Amended Complaint says SWAPA interviewed 3 flight attendants and a first officer, briefed senior union officials and helped arrange for Haak to attend a Montreal behavioral program that employees called \u201cCharm School.\u201d<\/p>\n\n\n\n

Janning alleges that Southwest and SWAPA failed to disclose those reports during the federal investigation. She also alleges that Southwest instructed employees not to cooperate with the FBI until investigators objected.<\/p>\n\n\n\n

SWAPA Supported Haak, Janning Alleges<\/h2>\n\n\n\n

When Haak appeared for sentencing, SWAPA vice president Mike Santoro wrote to the federal judge on his behalf, describing Haak as having a \u201cspotless employment and training record\u201d and no employment-related complaints requiring union representation.<\/p>\n\n\n\n

Janning alleges that SWAPA knew about the earlier complaints and that Santoro’s statement to the judge was false.<\/p>\n\n\n\n

She also alleges that SWAPA declined to challenge her grounding, lost pay and treatment by Southwest. During her grounding, she says her captain upgrade was revoked.<\/p>\n\n\n\n

Janning claims Southwest and SWAPA worked together to ground her, discredit her and retaliate against her after she reported Haak.<\/p>\n\n\n\n

Southwest’s Position<\/h2>\n\n\n\n

Southwest says it did not learn about the cockpit incident until after Haak retired. The airline says it cooperated with investigators, supported Janning and took action after learning about the conduct.<\/p>\n\n\n\n

The airline has denied claims that it retained a known predator, retaliated against Janning, defamed her or conspired with SWAPA.<\/p>\n\n\n\n

In court filings, Southwest has described parts of Janning’s allegations as \u201ctrumped up,\u201d \u201csensationalized\u201d and \u201cfantastical.\u201d It has also argued that her fear Haak might use the aircraft as a weapon was unsupported conjecture and questioned whether she sufficiently alleged that he physically prevented her from leaving the cockpit.<\/p>\n\n\n\n

Lawsuit and SWAPA’s Sanctions Request<\/h2>\n\n\n\n

Janning filed the lawsuit in Orange County Circuit Court on September 26, 2022. The case includes claims against Southwest for negligent supervision, negligent retention, retaliation, s*x discrimination, hostile work environment, libel and slander.<\/p>\n\n\n\n

Haak faces claims for s*xual assault, s*xual battery and false imprisonment. Former Southwest managers face defamation claims, while SWAPA is accused of participating in a civil conspiracy with Southwest.<\/p>\n\n\n\n

In December 2023, SWAPA moved to dismiss, arguing that Janning had not plausibly connected the union to an agreement to retaliate against her.<\/p>\n\n\n\n

SWAPA now argues that the claims against it are sufficiently frivolous to justify sanctions and payment of the union’s legal fees. The union initially sought to keep the sanctions motion confidential, but the Orange County, Florida<\/a> clerk rejected that request.<\/p>\n\n\n\n

The sanctions request remains part of the ongoing civil dispute. It does not itself establish that Janning or her lawyers committed wrongdoing.<\/p>\n\n\n\n
