Plaintiffs argue that time treated as unpaid in their contracts, or paid at reduced rates, such as time spent working at the airport, should count as hours worked.<\/p>\n\n\n\n<p>Under that view, they should receive time and a half on their regular wages for those hours. American Airlines, Inc., filed as No. 1:26-cv-00626 in the Northern District of Illinois.<\/p>\n\n\n\n<p>Last week, American failed to convince the court to throw it out at the early stage, allowing the claims to advance.<\/p>\n\n\n\n<p>Illinois treats overtime as mandatory and non-waivable. An employer cannot have an employee work more than 40 hours in a week without paying overtime at a rate of at least one and a half times the regular rate.<\/p>\n\n\n\n<p>The federal Fair Labor Standards Act includes an overtime exemption for airlines, but that exemption does not block claims brought under state law.<\/p>\n\n\n\n<p>The financial stakes are significant. That gap sits at the center of the underpayment argument.<\/p>\n\n\n\n<p>The harder issue is defining the terms. Preemption applies only when a court must actually interpret disputed terms of the union contract to decide the claim.<\/p>\n\n\n\n<p>According to <a href=\"https:\/\/viewfromthewing.com\/american-airlines-flight-attendants-say-their-union-contract-shortchanged-them-now-theyre-suing-for-overtime-pay\/\" rel=\"nofollow\">View from the Wing<\/a>, if the question can be answered by looking at a pay stub, including hours worked, amounts paid, and what state law requires, the case can proceed.<\/p>\n\n\n\n<p>A contrasting example is Adames v. Executive Airlines, which was preempted. Crew members fly very different schedules.<\/p>\n\n\n\n<p>A single duty can begin in one state and end in another, mix international flying made up mostly of paid flight hours, and include short domestic hops with heavy boarding time and long sits.<\/p>\n\n\n\n<p>Some hold regular lines while others sit in reserve, which widens the differences further.<\/p>\n\n\n\n<p>This pattern is not limited to American.
