Tavade (President) and Member Vijay C. Premchandani dismissed Emirates\u2019 appeal and upheld the earlier order issued by the South Mumbai District Consumer Commission.<\/p>\n\n\n\n<p>The complaint, filed by Dr. Keshab Nandy and Mrs. Meenu Pandey, residents of Kharghar, Navi Mumbai, accused the airline of misleading them into paying \u20b97,200 for pre-booked adjacent seats.<\/p>\n\n\n\n<p>According to <a href=\"https:\/\/www.freepressjournal.in\/mumbai\/maharashtra-news-consumer-commission-upholds-order-against-emirates-airlines-for-charging-passengers-despite-availability-of-free-seats\" rel=\"nofollow\">Free Press Journal<\/a>, the couple had booked their tickets in August 2017. Dr. Nandy, a diabetic and hypertension patient, needed to sit next to his wife for medical assistance during the journey.<\/p>\n\n\n\n<p>However, upon boarding, they noticed that other passengers were allotted free adjacent seats \u2014 seats that had been shown as unavailable on the airline\u2019s website during booking.<\/p>\n\n\n\n<p>The District Commission\u2019s 2020 order directed Emirates to refund \u20b97,200 with 6% annual interest from October 5, 2017, in addition to \u20b95,000 for mental agony and \u20b93,000 as litigation costs.<\/p>\n\n\n\n<figure class=\"wp-block-image certain premium seats, they have a legal and ethical obligation to clearly disclose which seats are free and which require payment.<\/p>\n\n\n\n<p>Emirates\u2019 website, however, did not indicate the availability of free seats even after ticket confirmation, thereby misleading passengers.<\/p>\n\n\n\n<p>The bench held that Emirates\u2019 lack of transparency amounted to a violation of consumer rights, noting that passengers were kept \u201cin the dark\u201d about their true seating options.<\/p>\n\n\n\n<p>This omission effectively forced them to make a payment that was unnecessary, Consumer Affairs guidelines on \u201cdark patterns\u201d, which are deceptive design tactics used online to manipulate consumer behavior.<\/p>\n\n\n\n<p>Though these guidelines were not in effect when the incident occurred, the Commission stated that Emirates\u2019 conduct was \u201canalogous to a dark pattern\u201d, concealing free seat information and restricting informed consumer choice.<\/p>\n\n\n\n<p>\u201cThe complainants were compelled to pre-book seats by paying extra, even though free seats were available.
