ATLANTA-<\/strong> A woman is suing Delta Air Lines (DL)<\/a> after a series of flight disruptions prevented her from reaching her critically ill father in time to authorize a life-saving surgery.<\/p>\n\n\n\n

The passenger was traveling from Dallas-Fort Worth (DFW) to Rio de Janeiro (GIG) via Atlanta (ATL) and S\u00e3o Paulo (GRU), but flight delays and a booking issue resulted in her late arrival, with devastating consequences.<\/p>\n\n\n\n

Passenger Sues Delta Over Delay<\/h2>\n\n\n\n

Marcia Bayer, a Texas resident, received word on December 26, 2024, that her father in Rio de Janeiro had been hospitalized and urgently required surgery.<\/p>\n\n\n\n

The hospital, following Brazilian medical protocols, required in-person consent from a family member, as her father was too ill to give it himself.<\/p>\n\n\n\n

Acting quickly, Bayer booked a last-minute international ticket with Delta Air Lines (DL), departing from Dallas Fort Worth International Airport (DFW) on December 28, with a connection through Atlanta Hartsfield\u2013Jackson (ATL)<\/a> to Rio de Janeiro\/Gale\u00e3o International Airport (GIG). <\/p>\n\n\n\n

However, Delta informed her of a mechanical issue before departure, rerouting her journey through S\u00e3o Paulo\/Guarulhos International Airport (GRU), with a new expected arrival time in Rio on the afternoon of December 29, PYOK<\/a> reported.<\/p>\n\n\n\n

Upon arrival in S\u00e3o Paulo, Bayer encountered a major issue. Despite holding a valid boarding pass for her final flight to Rio, she was denied boarding due to her name not appearing on the passenger manifest.<\/p>\n\n\n\n

The 40-minute domestic connection was operated by Delta\u2019s Brazilian partner airline, which could not resolve the discrepancy without direct action from Delta.<\/p>\n\n\n\n

$250,000 Lawsuit Against Airline<\/h2>\n\n\n\n

Unable to get assistance from Delta\u2019s closed service desk at S\u00e3o Paulo Airport, Bayer was left with no choice but to purchase a new last-minute ticket to Rio for $675<\/strong>. She finally arrived at her father\u2019s hospital at 6:00 p.m. on December 29, only to learn that his condition had deteriorated. <\/p>\n\n\n\n

Though she gave the required authorization, the surgery was deemed too risky at that point, and her father passed away before it could be performed.<\/p>\n\n\n\n

Bayer has now filed a lawsuit in a Texas district court, seeking $250,000<\/strong> in damages for emotional distress, claiming that Delta\u2019s delay and ticketing mishandling directly resulted in her missing the window to save her father\u2019s life. <\/p>\n\n\n\n

Delta\u2019s legal team argues the airline fulfilled its contractual obligations and is not liable for emotional damages. However, they acknowledged that Bayer may be eligible for limited compensation under the Montreal Convention<\/strong>, which governs airline liability in international travel. This compensation is capped at approximately $7,670 (5,346 Special Drawing Rights)<\/strong>.<\/p>\n\n\n\n
